Terms of Service

By renting equipment from Red Moose Rentals ("Company"), you ("Renter") agree to the following terms and conditions.
Equipment Covered
This agreement applies to all equipment rented from Red Moose Rentals, including Dump Trailers, Car Haulers, Utility Trailers, Cargo Trailers, Tractors, and attachments and accessories provided with rental equipment.
Eligibility Requirements
To rent equipment, you must be at least 21 years old, possess a valid driver's license, provide accurate contact and payment information, and be legally authorized to operate the rented equipment. Red Moose Rentals reserves the right to refuse service at its discretion.
Rental Period
The rental period begins at pickup or delivery and ends when the equipment is returned and inspected. Tractor rentals require a minimum rental period of two (2) days. Rental extensions must be approved prior to the scheduled return time.
Payment Terms
Full payment is due before equipment is released unless otherwise agreed in writing. You authorize Red Moose Rentals to charge your payment method for rental charges, delivery fees, fuel charges, cleaning fees, toll charges, damage claims, late fees, collection costs, and any other charges authorized under this agreement.
Security Deposits
Trailer Rentals: A refundable security deposit of $100 is required for Dump Trailers, Car Haulers, Utility Trailers, and Cargo Trailers. Tractor Rentals: A refundable security deposit of $250 is required. Deposits may be used toward unpaid charges, damages, missing equipment, excessive cleaning, fuel charges, tolls, or late fees.
Delivery Fees
Delivery and pickup fees are based on distance from Red Moose Rentals: 0–50 Miles: $50 | 51–100 Miles: $100. Additional distances may require a custom quote.
Towing Requirements
The renter is responsible for ensuring their vehicle is capable of safely towing the rented trailer. Requirements include proper towing capacity, proper hitch and ball size, functional trailer wiring, working brake controller when required, safety chains connected, and roadworthy tires and vehicle condition. Red Moose Rentals may refuse rental if a vehicle appears unsafe or inadequate.
Proper Use & Prohibited Uses
Equipment may not be used by unauthorized operators, while under the influence of drugs or alcohol, for illegal activities, for racing or stunts, beyond rated capacities, to transport hazardous materials without approval, or outside the continental United States without written approval.
Insurance Responsibility
Red Moose Rentals does not provide insurance coverage unless specifically stated in writing. The renter is responsible for equipment damage, theft or loss, property damage, bodily injury claims, and third-party claims arising from equipment use. Proof of insurance may be required.
Damage Responsibility
The renter is responsible for all damage occurring during the rental period, including accidents, rollovers, theft, fire, vandalism, weather-related damage, improper loading, and improper towing. The renter agrees to pay repair or replacement costs.
Cancellation Policy
Cancellations made more than 48 hours before pickup may receive a full refund. Cancellations within 48 hours may be subject to fees. No-shows may forfeit deposits and reservation fees.
Late Returns
Equipment not returned on time may incur additional rental charges, administrative fees, and lost rental opportunity charges. Equipment overdue by more than 24 hours without approval may be considered unlawfully retained.
GPS Tracking
Some equipment may contain GPS tracking devices. By renting from Red Moose Rentals, the renter consents to location tracking for theft prevention, equipment recovery, rental verification, and fleet management.
Limitation of Liability
Red Moose Rentals shall not be liable for lost profits, business interruption, consequential damages, incidental damages, or delays caused by equipment failure. Maximum liability shall not exceed the amount paid for the rental.
Indemnification
The renter agrees to defend, indemnify, and hold harmless Red Moose Rentals, its owners, employees, agents, and affiliates from claims, damages, losses, costs, expenses, injuries, or legal actions arising from use of rented equipment.
Collection Costs
The renter agrees to pay all costs associated with collecting unpaid balances, including attorney fees, court costs, collection agency fees, and interest permitted by Texas law.
Governing Law
This agreement is governed by the laws of the State of Texas. Any legal action shall be brought in Williamson County, Texas.
Acknowledgement of Risk
The renter acknowledges that towing trailers and operating tractors involves inherent risks, including property damage, serious injury, and death. The renter voluntarily assumes all risks associated with the use of rented equipment.
